Appointment of Teachers in Delhi University: Will that take more than ten years?

Delhi University is facing a crisis on the issue of appointments of teachers as till a year ago the issue was not even seen to be on the priority that it deserved, for almost a decade. It was neither given due attention by the University nor by the Delhi University Teachers' Association (DUTA) that has been led mostly by communist Presidents during this period. And surprisingly, this has happened despite the fact that barring a short period of ban from March 2018 to March 2019 (as a result of a court verdict) there were no government orders against making appointments. In 2016 December, Delhi University had to make a promise to Delhi High Court that it would complete the task of making all 3500+ appointments by July 2017. It failed to do that. And despite proactive steps taken by UGC/HRD in notifying a time-schedule in May-June 2019 asking the university to follow it and make all appointments in six months, Delhi University is yet to take off. However, the issue of appointment of teachers in Delhi University is not as simple as it might appear and it needs to be studied in some detail and that is being attempted here.

Present Status

Let us first estimate the present size of the problem which is the main parameter which indicates that this particular concern of Delhi University must be given the highest priority. On an average 300 teachers retire each year from Delhi University. From 2007 there have hardly been any significant drive for permanent appointments. Therefore, in thirteen years around 3900 vacancies must have got created due to retirement of teachers by now. The University was sanctioned around 2000 posts under the first tranche of OBC expansion in 2009. The total vacancies contributed by these factors would add up to 5900. Out of which around 1400 appointments were made and therefore about 4500 posts must be still lying vacant out of these. 2000 additional posts that were due since 2010 under second tranche of OBC (Other Backward Castes) expansion were sanctioned by the UGC last year in 2019. This makes the total vacancies in 2019 as 6500. This year, apart from the 300 posts that will get created due to retirement, University is also expecting around 2000 posts under EWS (Economically Weaker Section) expansion scheme. These factors would make the number reach 8800 approximately. These figures are displayed below in a self-explained tabular format.

An explosive situation

Right now, around 5000 teachers must have been working as permanent teachers. Rest around the same number are working as Adhoc teachers. These teachers have been working under extreme uncertainty as they are appointed only for four months at a stretch and are continued again after a day's break. After the sanction of posts due to EWS expansions therefore, the strength of permanent teachers will get reduced to around 40 percent. Any education institution would not be able to perform to its potential if 60 percent of their staff are working under uncertainty. In the past several UGC Regulations, it is clearly mentioned that not more than 10 percent strength should be working on such uncertain service conditions. There is an urgent need to address this problem as it has been allowed to get accumulated to such alarming level primarily due to overlooking of the problem by the authorities. Any further lapse may only make the situation more explosive and beyond repair.

Reason for not holding interviews

Following major reasons can be traced for not holding interviews.

1. Due to continuous experimentation with the course structure moving from annual to semester in 2009-10 and then to FYUP in 2011-12, back to semester in 2015 and then CBCS in 2017, there was an uncertainty about the permanent requirement of some of these vacancies.
2. Adhoc teachers were considered to be useful (exploitable) for executing swift changes in the course structures as seen during the initial phase of this period.
3. Authorities have apparently avoided making appointments fearing it difficult to handle because of its huge number, at least since 2016.
4. UGC directing the university against making appointments between March 2018 to March 2019 to avoid frequent changes in the appointment roster from 200 point department wise roster to 13 point institution wise roster and back again to 200-point roster.
5. Convenience in making adhoc appointments that has remained in practice for the last more than forty years.
6. Selection committees in pre-2005 era had an edge for the college authorities in making decisions and this was reversed in 2005 in favour of the University teachers by making a decisive change in the constitution of selection committees. An EC resolution gave similar deciding edge to the college authorities for adhoc appointments. Colleges, since then started avoiding holding interviews for permanent posts and preferred adhoc appointments.

Is it possible to fill posts through the existing process of appointments

In response to the advertisements to fill up these posts last year, colleges have received applications in huge numbers. There are on an average around 1500 to 2000 applicants for each department of a college and typically, a college has 10-12 departments in DU. A college that has 12 departments where interviews need to be conducted, would require to hold twelve selection committees that on an average would conduct interviews for 50-60 days. In all of these, presence of Principal and Chairman would be required. Theoretically, this might appear to be possible but it is difficult for any institution to postpone all other activities for holding selection committees. Then a department in the University that would be required to send experts in all the colleges where selection committees will be held in their subject, will also feel the pressure to perform. This is because there are departments whose courses run in more than 30-40 colleges. To manage such a schedule will never be an easy task. The departments will also have to ensure that no two dates in different colleges clash in this schedule as it would deny the candidates their fair opportunity to appear in both the interviews. 

Without getting into the complex details given above, we can try to arrive at a fair estimate using our earlier experiences and attempts. During 2015-16, in approximately more than a year the university was able to conduct interviews to fill up around 8-900 posts. That was a decent drive carried out for a short time when the university had put the appointment drive on its highest priority and therefore, we should not expect to cross on an average 7-800 selections in an year even now. Since there are 300 posts getting additionally vacated due to retirement, one can only target to reduce the number of vacancies by approximately 500 posts (i.e. by making appointments at a challenging rate of 800 per year) in a year. To fill up the 6500 posts therefore (including OBC second tranche but excluding EWS expansion posts), it would take another 13 long years, assuming no adverse developments spring up to stop this exercise during this long period of time. If EWS posts are also added, it would take around fifteen years.

As a matter of fact, it is enough to know that to fill up just 126 posts in the Faculty of Law, interviews were held for more than three months in 2017 that began on July 24 and ended on September 29. And appointment letters to the selected candidates were issued only after the list was approved on January 27 2018. It was just ridiculous that the University had to accept in Delhi High Court in December 2016 that it would complete the process of making appointments in seven months by July 2017. Such a target was simply impossible to achieve under the prevailing scheme of making these appointments. If only the number is somehow (Absorption is just one of those ways) reduced by at least half, the process cannot be completed in five-six years of time. And for this also, university will have to keep appointments on its highest priority.

Final Year Assessment of Students must not be compromised in the name of pandemic for narrow political gains

After the court directed Delhi University to conduct final year undergraduate examinations from August 10 and finish it up in the same month, the university is now left with the task to complete this exercise keeping the interest of career of students in mind. This particular degree weighs very heavy in the education-life of the students and any compromise in the credibility of the same is bound to affect their professional progress adversely. On the other hand, if an impression is allowed to get created in the open, that the degree obtained this year is not going to be of the worth the grades that the students would score, it would leave an irreversible impact in the minds of the employers and will adversely affect the job prospects of especially the hardworking meritorious students.

This year, the students have passed through a real tough time of their entire education years. First, the sponsored anti-CAA related violent protests that were then followed by the scary anti-Hindu riots in Delhi, must have impacted their studies adversely till end of February. And then it was followed by the world wide fierce spread of a Chinese virus COVID-19 that has gripped the entire world even now and like that was never heard or imagined before.

Students, and especially the hardworking and meritorious ones, must have studied this year in extreme trying circumstances braving all the problems and challenges coming in their way one after the other. These students had to quickly adapt to unfamiliar methods of online teaching; explore new ways to connect to their teachers; clear their doubts through WhatsApp groups; search through Google looking for specific information; use of social media for different updates; connect to peers for news and what not. Learning these skills itself must have made them equipped to face the challenges of life in a much better way than their seniors. These students have learnt so many other skills and real lessons of life along with their subjects that it would be unfair to them if they get rated in a manner that might suggest a doubt on the worth of their grades.

Degrees without any kind of assessment might look attractive for those few students who hardly take their studies seriously but for serious students it is bound to work as dampener for their spirits since they would find their unusual efforts that they have put in this semester, going unnoticed in the end.

Delhi University must find a way to conduct the examinations that would make the assessment of all kinds of acquired skills of the students and judge the amount of study and hard work that they have put in this year, in the fairest possible manner.

It is disappointing to notice that there are some political forces that is wanting to exploit this hard and trying time of students to suit their narrow political agenda. The students’ union of Delhi University, DUSU, however has behaved in the most sensible way in this crisis situation and were seen to be trying to give priority only to the well-being and interest of students. They have till now refused to get carried by the otherwise attractive but having a long-term negative impact of opting for an easy way to get degrees without a credible form of assessment. It is good that such a crucial and important decision is not being allowed to get influenced by politics.

While there lies a danger that the pandemic may stay longer than expected and the requirement of observing physical distancing will have to be continued for some time, there is no doubt that the education sector will have to learn and adopt online ways of teaching and evaluation in recent future. However, it would be a real test of our combined capacity of finding and inventing an online/offline method of conducting examinations that will help in honestly assessing our students, keeping the sanctity of examinations intact and the results of the evaluation fair and still maintain the requirement of physical distancing.

समायोजन का लक्ष्य - राजनीतिक लड़ाई से नहीं, कानूनी रास्ते से ही हासिल करना संभव

राजनैतिक जोड़ तोड़ और सत्याग्रही आंदोलनों के रास्ते से हमें 5-6 दिसंबर को एच आर डी (HRD) का जो पत्र मिल पाया वो भी हम विश्वविद्यालय में पूरी तरह से लागू करा पाने में अभी तक असमर्थ रहे हैं। अगर हम एडहॉक नियुक्तियों का इतिहास देखें तो पाएंगे कि वैसे तो ऐसी नियुक्तियां चार पांच दशकों से चल रही हैं मगर परेशानी तब से बढ़ी जब 2007-8 से स्थाई नियुक्तियां लगभग रुक सी गयीं। और फिर 2007-8 से लेकर 2014-15 तक दिल्ली विश्वविद्यालय में हर वर्ष एक एडहॉक शिक्षक को हटाकर उसी के स्थान पर दूसरे को लगाने का अनियमित कारोबार एडहॉक शिक्षकों को प्रताड़ित करने के मकसद से खुले आम चला। तत्कालीन केंद्रीय मंत्री स्मृति ईरानी की पहल पर FYUP वापसी के दौरान यु जी सी के द्वारा लिखे गए जुलाई 2014 के ऐतिहासिक पत्र के बाद से कम से कम ये घृणित सिलसिला बहुत बड़े स्तर पर विश्वविद्यालय में रुका, जिसमे यह कहा गया था कि सभी एडहॉक शिक्षकों को नए सत्र में अपने पुराने पदों पर नियुक्ति दिया जाय। इसी कारण से पांच वर्ष से या उससे अधिक समय से काम कर रहे एडहॉक शिक्षकों की संख्या आज 2000 से कुछ ज़्यादा अवश्य होगी।

जो लोग समायोजन को क़ानूनी तौर से असंभव मानते हैं उन्हें ऐसा इसलिए लगता है क्योंकि एडहॉक शिक्षकों के लिए जो चयन समिति गठित की जाती है वो यु जी सी के रेगुलेशंस के आधार पर नियमित नहीं माना जा सकता। ऐसे लोगों के विचार में,  क्योंकि स्थाई शिक्षकों की नियुक्तियों की चयन समितियां इन चयन समितियों से भिन्न होती हैं इसलिए एडहॉक शिक्षकों का समायोजन बगैर स्थाई नियुक्तियों की चयन समितियों के सामने साक्षात्कार दिए हुए करने की इजाज़त कानून कभी नहीं देगा। हालांकि इस बात से इंकार नहीं किया जा सकता कि दोनों तरह की नियुक्तियों के लिए चयन समितियां एक जैसी नहीं होती, लेकिन ये कहना कि एडहॉक शिक्षकों की चयन समितियां नियमित ही नहीं होती है, ना तो ठीक है और ना ही ऐसा कहकर न्यायालय के आगे विश्वविद्यालय खुद ही अपनी मुसीबत बुलाएगा। न्यायालय में ऐसी दलीलें काम नहीं आएँगी क्योंकि सबको पता है कि आज विश्वविद्यालय में आधे से ज़्यादा शिक्षकों की नियुक्तियां इसी पद्धति से हो चुकी है और विश्वविद्यालय प्रशासन भी इस प्रक्रिया में भाग लेता रहा है। ये कहना कि ये चयन समितियां सिर्फ चार महीनों की नियुक्तियों के लिए थीं - भी विश्वविद्यालय के खिलाफ ही जाएगा क्योंकि ऐसी पद्धति से की गई नियुक्तियां जब इतने वर्षों तक चल रहा था तो उन्होंने ना सिर्फ कोई कार्यवाई नहीं की बल्कि एडहॉक पैनल बना बना कर उसमे सहयोग ही किया। हमारी दलील के पक्ष में उच्च और सर्वोच्च न्यायालयों ने कई बार निर्णय दिए हैं, क्यूंकि न्यायालय तकनीकी कारणों की आड़ में अन्याय करने वालों का पक्ष नहीं ले सकती। नीचे दिए गए दो लिंकों पर न्यायालयों के निर्णयों को पढ़कर हम आश्वस्त भी हो सकते हैं।

रजनी अब्बी बनाम दिल्ली विश्वविद्यालय के मुक़दमे के 2016 दिसंबर को दिए गए निर्णय में दिल्ली के उच्च न्यायालय ने विश्वविद्यालय को यह कहा था कि वो जुलाई 2017 तक सारे रिक्त पदों के साथ साथ उन पदों पर भी नियुक्तियां कर लें जहां एडहॉक शिक्षक कार्यरत हैं। इतना ही नहीं उस निर्णय में यह भी कहा गया था कि अगर विश्वविद्यालय को इस काम को पूरा करने में कोई दिक्कत नजर आए तो वो न्यायालय से समय रहते ही इस समय सीमा को बढ़ाने की गुहार लगा सकती है।

मेरी समझ से विश्वविद्यालय ने इस निर्णय की साफ तौर पर अनदेखी और अवहेलना करके हमारे समायोजन की मांग को अनजाने में ही एक बहुत बड़ा कानूनी हथियार दे दिया है। वैसे मार्च 2018 में रोस्टर के कारणों से यू जी सी के द्वारा नियुक्तियों पर रोक लगी जरूर थी मगर वो भी मार्च 2019 को हटा दी गई थी। इस बात को भी अब एक वर्ष से कहीं ज़्यादा हो गया। यू जी सी के द्वारा मार्च 2019 से चलाए गए समयबद्ध तरीके से नियुक्ति के कार्यक्रम में जहां बाकी सभी केंद्रीय विश्वविद्यालयों ने बड़े स्तरों पर नियुक्तियां की भी हैं, वहीं दिल्ली विश्वविद्यालय में अभी तक एक भी नियुक्ति नहीं हुई।

हां, लेकिन एक बात हमें मानना होगा की न्यायलय में हम उन एडहॉक शिक्षकों के समायोजन के पक्ष में कोई ठोस दलील नहीं दे पाएंगे जो कल ही अपने पदों पर नियुक्त हुए हैं। मुझे लगता है कि हमें जुलाई 2017 के दिल्ली उच्च न्यायालय के निर्णय को महत्व देकर एक कानूनी लड़ाई लड़ने की तैयारी करनी चाहिए जिसमें उन सभी एडहॉक शिक्षकों के समायोजन के लिए मांग की जाए जो जुलाई 2017 या उससे भी पहले से कार्यरत हैं। इस तारीख का एक कानूनी महत्व है जिसे कोई न्यायालय नज़रअंदाज़ नहीं कर पायेगा।

मेरे अपने अनुमान से जुलाई 2017 से लगातार कार्यरत एडहॉक शिक्षकों की संख्या 3000 के लगभग होगी जिन्हें समायोजन की प्रक्रिया से स्थाई बनाने का क़ानूनी रास्ता सफलता की आशा के साथ तय करने की उम्मीद की जा सकती है। बाकी के 2-3000 पदों पर साक्षात्कार की सामान्य पद्धति से नियुक्तियां जोरों से शुरू करने की मांग भी अगर साथ में की जाए तो हमारे मुक़दमे को एक सही दिशा मिल सकती है।

मगर ये कानूनी लड़ाई जीतने के लिए हमें अपनी पूरी शक्ति लगानी पड़ेगी। अगर ऐसे शिक्षकों का एक ग्रुप बनाकर सभी 3000 शिक्षक आर्थिक सहयोग करें तो हरेक के 1000 रुपयों से ही एक ही बार में तीस लाख का ऐसा फण्ड बन जायेगा जो देश के बड़े से बड़े वकील को इसका पक्ष लेने के लिए खड़ा करने में उपयोग में लाया जा सकेगा। न्यायालय में हमारा पक्ष कौन रख रहा है, इस बात का कितना महत्व है यह हम सब जानते हैं। इस प्रयत्न से कुछ ही महीने में हम कानून के रास्ते से शायद वो हासिल कर पाएंगे जो हम इतने वर्षों की राजनैतिक जोड़ तोड़ और सत्याग्रही आंदोलनों के द्वारा हासिल नहीं कर पाए।

डूटा में शिक्षकों को RTI और अन्य क़ानूनी मदद देने के लिए एक सेल बनाने की आवश्यकता

डूटा (दिल्ली यूनिवर्सिटी टीचर्स एसोसिएशन) को अपने वामपंथी पाषाण-युगी तरीकों को छोड़कर आज के डिजिटल युग को ध्यान में रखकर उसके अनुसार अपने आपको ढालने और अपनी कार्यशैली में युगानुकूल बदलाव लाने की जरूरत है। पुरानी घिसी पिटी वामपंथी रणनीति और एजेंडे के तहत प्रायोजित आंदोलन खड़ा करने का दौर अब नहीं रहा। आंदोलन खड़ा करने के नाम पर बात-बात में मास-कांटेक्ट के निष्प्रभावी कोशिशों से शिक्षक नेताओं को राजनितिक लाभ तो मिलता होगा मगर आम शिक्षक इसमें अपने आप को ठगा  सा ही महसूस करता है। अब इस तकनीकी युग में या तो विराट स्वरुप में स्वतःस्फूर्त खड़ा हो जाने वाले आंदोलनों की मांगों पर ध्यान दिया जायेगा या फिर तर्क के बल पर अपने पक्ष का वजन स्थापित करने वाले की जीत होगी। सूचना और तकनीकी के इस युग में मुट्ठी भर लोगों द्वारा बल प्रयोग करके आंदोलन खड़ा करने और अपनी बात मनवा लेने के पुराने वामपंथी तरीके अब उलटे भी पड़ने लगे हैं। CCTV और हर हाथ में मोबाइल कैमरा होने के दौर में भीड़ का हिस्सा बनकर ज़ोर जबरदस्ती करने का दुष्परिणाम भी अब सामने आने लगा है।आर्टिफिशियल इंटेलिजेंस के उपयोग से दंगे जैसी स्थितियों में भी गुनहगारों की शिनाख्त कर पाना ज़्यादा मुश्किल नहीं रहा। आर्थिक मदद देकर आंदोलन खड़ा कर लेने की पुरानी रणनीति भी अब बैंक खातों में दर्ज सूचनाओं की मदद से उजागर हो जाती हैं और पुलिस कार्यवाई के लिए उपयोग में भी लाई जा रही हैं।

मगर चार दिसंबर 2019 के दिन जब डूटा के आह्वान पर छह सात हजार शिक्षकों ने दिल्ली विश्वविद्यालय के कुलपति के दफ्तर पर कब्ज़ा किया था, तो वो आंदोलन स्वतःस्फूर्त तो था ही, उसका स्वरुप भी विराट था। यह शक्ति हमें उन पांच हजार अस्थाई शिक्षकों के ऊपर आये अकस्मात् संकट की वजह से मिली थी जिनकी नौकरी कुलपति द्वारा अगस्त 28, 2019 की रात को जारी किये गए के एक पत्र की वजह से ख़त्म होने के कगार पर आ गई थी। 2018 में UGC द्वारा लाये गए तीसरे संशोधन के समय भी कई अस्थाई शिक्षकों की जीविका एक झटके में खतरे में आ गई थी और शिक्षकों ने अभूतपूर्व संख्या में उस आंदोलन में भाग लिया था। इन आंदोलनों में शिक्षकों की अप्रत्याशित, अभूतपूर्व और स्वतःस्फूर्त भागीदारी ने सरकार को शिक्षकों की बात सुनने और मानने के लिए मजबूर कर दिया।  इसके विपरीत विवेकानंद कॉलेज के प्राचार्या द्वारा स्पोर्ट्स विभाग में कार्यरत शिक्षिका के खिलाफ लिया गया अन्यायपूर्ण निर्णय इसलिए वापस नहीं हो पाया क्यूंकि उस आंदोलन में सिर्फ स्पोर्ट्स के शिक्षकों ने आगे बढ़कर भागीदारी की, जो संख्या में अधिक नहीं हैं। इस अन्याय के खिलाफ शिक्षिका को न्यायलय के पास जाना पड़ा। ऐसे ही कई और अन्याय के मामलों में, जैसे दशकों से बंद पदोन्नति के मुद्दों को लेकर सुनवाई सिर्फ इसलिए नहीं हो पा रही है क्यूंकि इसको लेकर शिक्षक भारी संख्या में प्रभावित भी हैं और उद्वेलित भी हैं मगर स्वतःस्फूर्त आंदोलित होकर बड़ी संख्या में भाग लेने की मनः स्थिति में शायद नहीं हैं। 

किसी शिक्षक की व्यक्तिगत परेशानी या फिर कुछ सीमित शिक्षकों की एक जैसी परेशानियों को दूर करने के तरीकों में और भारी संख्या में अन्याय से प्रभावित लोगों की परेशानियों को दूर करवाने की रणनीति में अब फर्क करना होगा। भारी संख्या में सडकों पर आने की हद तक उद्वेलित करने वाले मुद्दे पर अलग रणनीति और भारी संख्या में प्रभावित होते हुए भी सडकों पर आने के लिए तैयार नहीं होने की स्थितियों में कोई अलग रणनीति अपनाने का सोचना पड़ेगा। पहले जो डूटा के बीस-पचास एक्टिविस्ट किसी अधिकारी के कमरे में जाकर ज़बरदस्ती बल प्रयोग से जो अपना आक्रोश जाहिर कर जाते थे, उसका समय अब नहीं रहा। ऐसे मुद्दों के लिए RTI जैसे नियमों और न्यायलय की मदद लेने में डूटा को अब परहेज नहीं करना चाहिये। डूटा का अपना एक RTI एक्टिविज्म का विंग और अपना ही एक लीगल सेल होना चाहिए। डूटा के पास क़ानूनी सलाहकारों और क़ानूनी कार्यवाई करने वाले क़ानूनी विशेषज्ञों का पैनल होना चाहिए जो पहले से ही तय राशि पर शिक्षकों या उसके समूह या फिर डूटा को ही आवश्यकतानुसार सलाह या मदद कर सके।

पिछले दशक में किये गए कई डूटा आंदोलनों की समीक्षा करने से ये निष्कर्ष निकलता है कि हर बड़े आंदोलनों का अंत न्यायलय के निर्णय के साथ हुआ है। सेमेस्टर के विरोध के आंदोलन का अंत न्यायालय में हुआ, रोस्टर जैसा गंभीर मुद्दा भी न्यायालय में तय हुआ, कई बार परीक्षा मूल्याङ्कन के बहिष्कारों के मामले, या लम्बे समय तक चल रहे शिक्षक हड़तालों को समाप्त करने के मुद्दे PIL के द्वारा न्यायालय में ही तय होते रहे हैं और डूटा को उनको मानना भी पड़ा है। लेकिन यह भी सत्य है कि शिक्षकों के मुद्दों पर डूटा खुद कभी भी न्यायलय नहीं गयी। इसका कारण तो ये है कि डूटा रजिस्टर्ड संस्था नहीं है लेकिन डूटा खुद किसी पीड़ित की मदद करने के लिए आगे बढ़कर क़ानूनी सहायता दिलाने की कोशिश आधिकारिक और नीतिगत तौर पर भी नहीं करती है, ये एक ऐसी कमी है जिसे हमें डूटा में RTI और लीगल सेल बनाकर जल्दी ही दूर कर देना चाहिए। मुझे लगता है कि इस बात का हमें नुकसान भी उठाना पड़ा है क्यूंकि जब विश्वविद्यालय और सरकार से शिक्षकों को जवाब मांगने की ज़रूरत होती थी तब न्यायलय में डूटा खुद कटघरे में खड़ा कर दिया जाता रहा है। नतीजे में हम प्रहार के बजाय बचाव के लिए लड़ाई लड़ने के लिए मजबूर हो जाते रहे हैं।

पेंशन के मुद्दे पर शिक्षकों को न्यायलय में जाने के अतिरिक्त कोई चारा नहीं बचा था, रिकवरी जैसे अहम् मुद्दे पर किसी ने न्यायालय में गुहार नहीं लगाई, पदोन्नति और समायोजन के मामलों में भी कोई न्यायालय नहीं गया। नतीजा ये है कि हम पेंशन के मुद्दे पर एक निर्णायक स्थिति में एक दो बार पहुंचे भी, मगर बाकी मुद्दों पर हम कहीं भी नहीं हैं। स्पोर्ट्स के शिक्षकों के मुद्दे पर भी हमारा बचाव एक पत्र के जवाब में आये UGC के उत्तर की सहायता से एक शिक्षिका के न्यायालय में जाने से ही संभव हो पाया है। बाकी मुद्दों पर भी डूटा को सड़कों पर आने वाले आंदोलन का रास्ता तभी लेना चाहिए जब सचमुच में शिक्षक की संख्या निर्णायक तौर पर सुनिश्चित हो। सामान्य तौर पर कई नीतिगत मुद्दों के विरोध में दस हज़ार शिक्षकों का प्रतिनिधित्व करने वाली डूटा जब सरकार को सौ, दो-सौ  शिक्षकों की उपस्थिति दिखा पाती है तो अपने साथ साथ सारे शिक्षकों को एक हास्यास्पद स्थिति में डाल देती है। इससे डूटा के पदाधिकारियों का सिर्फ राजनितिक एजेंडा सिद्ध होता है और कुछ नहीं। इससे अलग हटकर ऑनलाइन पेटिशन, प्रभावशाली ट्विटर ट्रेंडिंग और सोशल मीडिया के उपयोग से हज़ारों की संख्या में पीड़ितों के हस्ताक्षर किसी भी समय में सौ - दो सौ लोगों की मामूली भीड़ से कहीं ज़्यादा प्रभाव डालने में समर्थ हो सकता है। वैसे ही एक निश्चित समय में कॉलेज के कार्यकाल के बाहर पांच हज़ार शिक्षकों के समूह को एकत्रित करना, हफ्ते भर से चल रहे शिक्षक हड़ताल से ज़्यादा प्रभाव डाल सकता है।

अतः निष्कर्ष ये कि डूटा को पहले तो शिक्षकों के ऊपर हो रहे अन्याय के मुद्दों की पहचान करनी होगी। इसके बाद व्यक्तिगत मुद्दों पर पहले बातचीत फिर लिखित आवेदन और बाद में RTI का सहारा लेना चाहिये। इन बातों के लिए डूटा में शिक्षकों की मदद करने के लिए सेल होना चाहिये।  इसके बाद समस्याएं न सुलझने कि स्थिति में शिक्षकों को क़ानूनी सलाह देने के लिए क़ानूनी सलाहकारों का और न्यायलय में उनके मुद्दों को ले जाने वाले अच्छे वकीलों का एक पैनल डूटा के पास होना चाहिए जहाँ से शिक्षक क़ानूनी सलाह और मदद लेने का सोच पाएं। कई वर्षों से कार्यरत एडहॉक शिक्षकों के समायोजन की जायज़ मांग हो, टीचर वेलफेयर फण्ड का उपयोग ना करने देने का विश्वविद्यालय का अन्यायपूर्ण रवैया हो, प्रावधानों के रहते भी पदोन्नति ना देने का मामला हो या फिर कोविड महामारी काल में ग्रीष्मावकाश के दौरान कार्यरत एडहॉक शिक्षकों के न्यायोचित वेतन के मुद्दे पर कानून हमारी बहुत बड़ी मदद कर सकता था मगर डूटा की रणनीति में इसको कभी भी शामिल नहीं रखने की सोच की वजह से हमने कभी इस ओर ध्यान ही नहीं दिया। मगर अब डूटा को इसमें सुधार लाने की आवश्यकता है।
